We invite you to a 3-part module taught by Prof. Dr. Gian Maria Farnell (University of Bologna) which focuses on the challenges of protecting marine biodiversity both within and beyond national jurisdiction. It provides an overview of the legal frameworks, treaties, and international agreements aimed at governing marine biodiversity protection through systemic interpretation of relevant treaties.
- The module will first address the customary legal framework codified by the United Nations Convention on the Law of the Sea concerning States’ powers and duties on the protection of the marine environment and the relevant international case law. During the module, the two agreements implementing UNCLOS, namely the 1995 Agreement relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks and the recent Agreement on the Conservation and Sustainable Use of Marine Biological Diversity of Areas Beyond National Jurisdiction, will be analysed, too.
- Second, the module will illustrate the interactions between UNCLOS and UNCLOS-related obligations and other sectorial conventions specifically geared towards the protection of biological diversity, namely the Convention on Biological Diversity and the 2010 Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization.
- Third, a part of the module will be devoted to analysing the interplay between the above general framework, and regional framework on the protection of marine environment in specific sea areas, such as the OSPAR Convention, the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean, the Convention for the Protection of the Marine Environment of the Baltic Sea and the Black Sea Biodiversity and Landscape Conservation Protocol.
